2. PERSONAL DATA WE PROCESS, PURPOSE OF THE PROCESSING,AND LEGAL BASIS
We are very happy that you want to join us! To process your application properly, we need to have certain personal data of you.
When you apply directly to us, we will receive this personal data:
Your full name;
Your address;
Your email address;
Your phone number;
Your LinkedIn profile;
Information on your previous employments;
Your resume and covering letter; and
Answers to certain qualifying questions for the job.
You may voluntarily provide us further information that you might think is beneficial to your application.
We may also receive this personal data from someone else, like a current employee of ours who recommends you, from an agency, or from your LinkedIn profile.
We process your personal data, as it is necessary to take steps at your request prior to entering into an employment contract (Art. 6(1)(b) of the GDPR), or certain more specific legal bases in certain countries, as applicable – like Section 26(1) of the German Data Protection Act, for instance. When we conduct an interview with you, we may also document the conversation, e.g. by taking notes (Art. 6(1)(f) of the GDPR). Our legitimate interest is to document the content of interviews completely and accurately, to be able to conduct interviews attentively and efficiently, and to assess and compare applicants fairly and consistently.
When we can offer you a position and you accept, we will forward your personal data to our People Ops team that will use your personal data to enter into the employment contract with sennder or one of its affiliates.
When we unfortunately are not able to offer you a position or you do not accept our offer, we will retain your personal data for a certain period (see below under Section 4) to enable us to defend ourselves against potential legal claims (Art. 6(1) (f) of the GDPR).
To provide us with your personal data is a requirement to enter into an employment contract. However, you are not obliged to provide us with your personal data, but we may not process your application in that case.
We do not use automated decision-making (including profiling).
3. RECIPIENTS OF YOUR PERSONAL DATA
For our recruitment processes, we use the recruitment software as a service of Gem Software, Inc. who is a processor to us. For internal purposes, we use certain tools of service providers, including AI-supported tools, that are also processors to us.
As far as those processors are outside the EU, we have ensured that appropriate and suitable safeguards are in place when no adequacy decision of the European Commission exists – like in the case of Gem Software, Inc. – we have concluded so-called Standard Contractual Clauses with the provider.
You may contact us through the information provided below to obtain a copy of the relevant safeguards. Please specify in your request which safeguards are or could be relevant to you.
4. RETENTION PERIODS
In case we reject your application or you do not accept our offer, we will delete your personal data no longer than six months thereafter or, if there is a shorter statutory retention period established in your country, in accordance with that retention period.
5. YOUR RIGHTS
You have the right to access your personal data, and you have the right to rectify or erase your personal data, to restrict the processing of your personal data and to receive the personal data you have provided to us in a structured, commonly used and machine-readable format (data portability), all pursuant to the GDPR. You always have the right to lodge a complaint with a supervisory authority.
Right to object
You have the right to object at any time, on grounds relating to your particular situation, to processing of your personal data that is based on Art. 6(1)(f) of the GDPR (see Section 2). We will then no longer process your personal data for this purpose, unless we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.
